The Supreme Court has ruled that parental income alone cannot determine the “creamy layer” status for Other Backward Classes (OBC) candidates. Supreme Court of India observed that relying only on income creates unequal treatment among candidates from similar backgrounds. The judgment addressed long-standing confusion over whether income from private sector or PSU-employed parents should be treated differently from government employees. The Court emphasised that such distinctions violate constitutional equality principles. This clarification is expected to expand eligibility for several OBC candidates who were earlier excluded under the creamy layer category.

 

Impact on UPSC Civil Services Selection Process

The ruling is likely to affect UPSC Civil Services Examination (CSE) outcomes, especially for candidates whose OBC status was disputed earlier.
