The NMC has de-notified MSMER-2023 through a Gazette notification published on October 16, 2026. Annual Disclosure Report requirements continue, and the notification protects specified prior approvals, actions and pending proceedings under its saving provisions.
The National Medical Commission (NMC) has de-notified the Maintenance of Standards of Medical Education Regulations, 2023 (MSMER-2023). The notification withdraws these regulations while preserving the requirement for medical colleges to submit Annual Disclosure Reports (ADRs). It also protects specified approvals, actions and proceedings from before the de-notification. Medical institutions should review the official notification to understand how the change affects their regulatory obligations.
What Does the NMC Notification Say?
The NMC notification is dated October 14, 2026, and was published in the Gazette of India on October 16. The Commission issued it under provisions of the National Medical Commission Act, 2019, alongside the General Clauses Act, 1897.
Note: The NMC notification states that the de-notification takes effect from its publication in the Official Gazette.
Will Annual Disclosure Reporting Stop?
No. The notification expressly states that the requirement to furnish Annual Disclosure Reports continues under the NMC Act, 2019, and regulations applicable from time to time.
Medical colleges should therefore not interpret the withdrawal of MSMER-2023 as the end of their annual disclosure obligations. Institutions should continue to follow the applicable statutory and regulatory requirements and monitor further directions from the Commission.
What Happens to Existing Approvals and Pending Matters?
The notification includes transitional and saving provisions. These protect actions taken under MSMER-2023 before its de-notification, along with approvals, renewals, orders, decisions and directions issued under those regulations.
The notification also preserves relevant rights, obligations and liabilities that arose before de-notification. Applications, appeals, inquiries and other proceedings pending at that time are to continue and be disposed of under the earlier regulations insofar as applicable, subject to the new notification.
Matters arising on or after the de-notification date will be governed by the NMC Act and the statutory and regulatory provisions in force at the relevant time.
What Medical Colleges Should Do Next
Medical institutions should read the official notification rather than assume that all earlier regulatory requirements have disappeared. They should continue submitting required annual disclosures and review any pending applications or proceedings with their compliance teams.
Institutions should also check subsequent NMC directions for the rules that apply to future matters. The notification withdraws MSMER-2023, but it does not state that all medical education standards or regulatory oversight have been removed.
